1. OBJECT

The present Particular Conditions regulate the terms applicable to the purchase of the different products that are offered at any given time through the online contracting platform accessible on the Website (hereinafter, the Service).

The Service is aimed at Users of legal age, residents and non-residents of Lima, Peru, who have the legal capacity to understand and accept these Particular Conditions, as well as to comply with the obligations set forth herein and who have not been excluded for violating the terms and conditions of the Website (hereinafter, individually, the Buyer; collectively, the Buyers).

When purchasing product(s) through the Service, a contractual relationship is established between the Buyer and the Entity.

 

2. INFORMATION ABOUT THE PRODUCTS. AVAILABILITY

2.1 General information

The descriptions, photographs, graphic or iconographic representations, and videos related to the Products offered through the Service, as well as the trade names, brands, or distinctive signs of any kind contained therein, aim to provide as much information as possible. However, the Buyer must keep in mind that they are for guidance purposes and, consequently, are not exhaustive.

2.2 Amounts

The prices, offers, promotions, or discounts announced in the Service are valid solely and exclusively for online orders made through it. The published prices are expressed in soles and include the IGV and other applicable taxes.

We take all reasonable precautions to ensure that the prices of the products are correct and up to date. If we discover an error in the price of the products that are part of your order, we will try to inform you in writing, giving you the option to continue with the purchase of the products at the correct price or to cancel your order.

In the event of any discount, increase, or additional charge, the Buyer will be informed in advance and, when applicable, will be offered the option to choose from the different options provided. In the purchase summary, the Buyer will also be informed of the total amount, breaking down the different concepts.

2.3 Stock

Products that are published through the Service at any given time may be purchased, provided there is stock of them. In case of stock shortages, the Entity reserves the right to offer the Buyer alternative products of equal or higher quality without price increase, and in any case, the Buyer may choose not to accept them and withdraw from their purchase.

The Entity reserves the right to decide, at any moment, which products are offered to Buyers through the Service, being able to modify and update the catalog at any time and without prior notice.

 

3. PURCHASE PROCESS

To initiate the purchase process, the Buyer must identify themselves in the Service. Once accessed with their identifier, they can select the products they are interested in, adding them to the shopping cart.

Once the selection of products and remaining options offered is completed, the Buyer will be directed to the confirmation page, where they can view all the items included in their order, so they can identify any errors and, if applicable, proceed to correct them.

If the order is correct and the Buyer does not need to correct any item, they can complete the purchase process by confirming the order and accepting these Particular Conditions, which constitute the contract between the Buyer and the Entity.

Once the purchase process is completed, the Buyer will receive the order confirmation via email and the charge for the purchase amount will be made to the chosen payment method. An order number will be assigned, which must be indicated in any subsequent communication that the Buyer may make regarding that order.

Payment for the products will be made through one of the means that are made available to Buyers at any given time.

 

4. DELIVERY OF PRODUCTS

Orders will be processed from Monday to Friday and will take a maximum of 12 hours to process. Once processed, the delivery time is no more than 2 days from the receipt of the order (This includes the 12 hours it may take to process the order). Saturdays, Sundays, and holidays are not included within the 2 days (Delivery period). Example: if the order was generated on Friday, the 2 days will be fulfilled by the end of Tuesday. The delivery time window for the products is from 10am to 6pm.

The Buyer (or a third party on their behalf) will receive products at the delivery address indicated during the purchase process or, failing that, at the address provided during the registration process. The recipient must verify the order, as well as record any incident observed regarding the order in the delivery document (whether digital or physical). The recipient's acceptance of the order implies acceptance of it and the transfer of ownership of the purchased products.

In the case of purchasing products whose sale is prohibited to minors under 18 years of age, the Entity reserves the right to carry out the necessary checks during the delivery process.

We will only make one delivery attempt and, if it cannot be completed, the products will return to the warehouse and the order will be canceled, proceeding to refund the amounts paid, once the cost of returning the products to the warehouse (“return cost”) is deducted.

 

5. POLRETURN AND WITHDRAWAL POLICY

5.1 Deadline and form

Once the product is delivered, the customer cannot withdraw from the purchase unless the product has a factory defect, within a maximum period of twenty-four (24) hours from when the Buyer or a third party designated by the Buyer, other than the carrier, takes possession of the products.

To exercise the right of return, the Buyer must notify Cacao Valley SAC at the email info@cacaovalley.com and indicate full name, order number, purchase receipt number, chocolate flavor, type of presentation (tablet, jar, box, etc.), batch number, and explain why they believe the product has a factory defect. Our after-sales team will contact them and then evaluate their claim and finally communicate with them within a period not exceeding 24 hours. If the claim is made on a Saturday, Sunday, or holiday, they will be contacted on the first business day from the date the claim was received.

In case the claim is accepted, the customer can choose between two options:

  1. Product exchange, The new product will be sent to replace the defective product. The exchange will occur only if the customer returns the defective product. Shipping costs will be covered by Cacao Valley S.A.C.
  2. Cancellation of the purchase, In this case, the money for the product subject to the claim will be refunded. The collection of the defective product will be coordinated with the customer for further analysis by our company. The refund will be made once Cacao Valley S.A.C. has custody of the defective product.

 

5.2 Conditions

To exercise the right of return, it is essential that the products have their complete packaging and that at least 80% of the product is present along with the invoice or receipt. If any of the requested requirements are not met, the Entity reserves the right not to accept the return of the products.

Before returning the product, the Buyer must ensure that it is properly protected so that it does not suffer any damage during transport.

 

5.3 Consequences

In case of a refund,

If the return is for the total order, all payments received will be refunded to the Buyer, including the shipping costs incurred for that order.

If the return is for one or more items from an order, the amount for those items will be refunded, excluding the shipping costs incurred.

The refund will be made using the same payment method used by the Buyer for the initial purchase. The Entity will withhold the refund until it has received the products that are part of the return.

 

6. WARRANTIES.

If the product is defective from the factory, the Entity will assume the replacement of the product, at no cost to the Buyer. Provided that it is communicated to the email info@cacacovalley.com within a period not exceeding 24 hours of receiving the product.

 

7. DISPUTE RESOLUTION.

The Entity is not obliged to participate nor will it resort to the online dispute resolution system before consumer arbitration bodies. If desired, the Buyer may access the electronic complaint book.
